On Wednesday, it was revealed that President Donald Trump\u2019s effort to surveil and prosecute former FBI Director James Comey could backfire, potentially resulting in his impeachment. In a new motion filed by Comey \u2014 who has been charged with threatening the president for posting a photo of seashells arranged in the numbers \u201c86 47\u201d \u2014 his attorneys noted that Secret Service agents told to surveil the former FBI Director admitted it was \u201clikely illegal<\/u>.\u201d This could spell doom not only for the case against Comey, but for Trump\u2019s presidency. <\/p>\n

According to CBS News<\/u>, in the motions filed late Tuesday, Comey\u2019s lawyers argue that the case \u201cshould be dismissed on the grounds of vindictive and selective prosecution.\u201d The motion also accuses the Secret Service of conducting “illegal electronic surveillance of Mr. Comey at the request of a high-level DOJ official” without a warrant shortly after Comey’s spring 2025 Instagram post. <\/p>\n

The motion describes a meeting on Air Force One between Trump and Secret Service agents, in which an agent supervisor told the president that his request to electronically surveil Comey was \u201c\u2018legally\u2019 a \u2018bad idea\u2019 because there was no belief of \u2018imminent danger to life\u2019 to justify warrantless surveillance.” Another agreed that it was “legally questionable” but indicated they \u201cmight do it anyway. The next day, the Secret Service conducted that surveillance.\u201d<\/p>\n

As CBS reports, \u201cFilings submitted by his lawyers show about \u2018pinging\u2019 Comey’s phone to track its location, which some personnel viewed skeptically, and a to provide location information due to an \u2018emergency\u2019 situation … \u2019At that time we did not believe that anyone’s life was in immediate danger and legally it was a bad idea to ping the phone,\u2019 an unnamed Secret Service official said.\u201d The affidavit filed by Comey\u2019s attorney, Patrick Fitzgerald, cited “substantial discovery provided by the Government.” <\/p>\n

According to George Conway \u2014 a lawyer running for Congress who has spent time in Trump\u2019s orbit as the former spouse of one of his top first-term advisors \u2014 these revelations could mean not only the end of the case, but the end of Trump\u2019s presidency. <\/p>\n

\u201cWay more than enough evidence in these papers not only to get Comey\u2019s charges 86\u2019d before trial in federal district court, but also to get Blanche \u2014 and Trump \u2014 86\u2019d at an impeachment trial in the Senate,\u201d posted<\/u> Conway. <\/p>\n

The motion lays out what Comey\u2019s lawyers argue is a clear pattern of \u201cintense bias,\u201d writing, \u201cHere, the government has singled out Mr. Comey for prosecution because President Trump harbors animus toward Mr. Comey and his protected speech, and it has done so in direct response to the president’s urgings.\u201d<\/p>\n
