Last week, the Trump administration quietly revealed the scheme it will use to label its opponents as domestic terrorists and target the power of government against them. So blatant is the undemocratic nature of their plan that one of President Donald Trump\u2019s closest aides declared that when it is put into action, appeals to civil liberties \u201cmust fall on deaf ears<\/u>.\u201d <\/p>\n

This is according to security expert Miles Taylor<\/u>, who served in the Department of National Security during Trump\u2019s first term and acted as a whistleblower when he shared the existence of a resistance movement within the White House. Taylor asserts that the Trump administration has developed a \u201cworkaround to use terror powers against his foes<\/u>.\u201d<\/p>\n

As Taylor explains, \u201cLast Thursday, Secretary of State Marco Rubio<\/u> gathered representatives from 66 countries at the State Department for something called the \u2018Ministerial on the Resurgence of Political Terrorism.\u2019 Stephen Miller was there to help rally the world against \u2018far-left political terrorism.\u2019 The actual purpose was something else. Trump\u2019s team was road-testing its blueprint for using America\u2019s counterterrorism machine against the president\u2019s enemies. And buried in the speeches was the legal trick they\u2019re planning to use.\u201d<\/p>\n

To understand the plot, Taylor notes, it is important to keep in mind that \u201cthere is no such thing as a \u2018domestic terrorist organization\u2019 under U.S. law. The government can only designate foreign terrorist organizations like al-Qaeda, ISIS, Hezbollah. When I helped run the Department of Homeland Security in the first Trump administration, those labels allowed us to take powerful action against global adversaries, including asset seizures, sweeping surveillance and prosecutions that could put a group\u2019s supporters away for decades.\u201d<\/p>\n

But because there is no legal domestic equivalent, Trump is unable to use these powers against his political opponents at home, so he\u2019s taking steps to circumvent the law. According to Taylor, Trump started by issuing an executive order declaring antifa a \u201cmajor terrorist organization,\u201d despite the fact that there is no such thing as an antifa organization. <\/p>\n

\u201cIt\u2019s a fake label,\u201d writes Taylor. \u201cThey\u2019re using it to open investigations into groups that don\u2019t like the president. Even still, they cannot use the government\u2019s most sweeping anti-terror powers against these folks. They must find other crimes if they want to bring a prosecution, like money laundering or fraud. Which brings us to the workaround.\u201d<\/p>\n

Here Taylor explains the three-step plan Rubio quietly laid out last week:<\/p>\n

\u201cONE, they\u2019ll designate foreign groups and call them \u2018antifa.\u2019 Last November, the State Department added four obscure European far-left groups to the Foreign Terrorist Organizations list, labeling all of them \u2018antifa.\u2019 Almost nobody<\/u> reported this tiny detail: only one of the four \u2014 a German outfit called Antifa Ost \u2014 even identifies with the antifa movement. There\u2019s no clear evidence linking any of them to activists in the United States. That didn\u2019t matter. The point wasn\u2019t the groups. The point was getting the word \u2018antifa\u2019 onto the FTO list. And Rubio promised this past Thursday that \u2018more designations\u2019 are coming.\u201d<\/em><\/p>\n

\u201cTWO, they\u2019ll declare it one big transnational network. This is what the ministerial was really for. Rubio told the assembled diplomats that today\u2019s far-left militants \u2018coordinate,\u2019 \u2018communicate,\u2019 and \u2018act together\u2019 across borders and that they can \u2018raise money in one country,\u2019 train in another and strike in a third. Miller claimed antifa factions worldwide draw from \u2018common networks of funding, organization and information sharing.\u2019 Notice what\u2019s happening. They\u2019re constructing a factual predicate that American activists are connected to the foreign groups they just designated.\u201d<\/em><\/p>\n

\u201cTHREE, they\u2019ll use \u2018material support\u2019 as the bridge to go after American citizens. Under federal law<\/u>, knowingly providing \u2018material support\u2019 to a designated FTO is a crime punishable by up to 20 years in prison. And material support is defined in breathtakingly broad terms. It can be money, \u2018services,\u2019 \u2018training,\u2019 \u2018advice or assistance’ or \u2018personnel.\u2019 Critics of the statute have warned that even sharing a Wikipedia link with a designated group could qualify.\u201d<\/em><\/p>\n

According to Taylor, \u201conce the government claims a left-wing nonprofit or a protest network is somehow providing \u2018material support\u2019 to a foreign terror movement, the entire post-9\/11 arsenal unlocks. That means it\u2019s easier for them to activate spy powers meant to monitor al-Qaeda; freeze bank accounts; seize assets; add individuals to terror watchlists; track financial transactions and more. They don\u2019t have to commit violence. They just have to be linked (by the government\u2019s own say-so) to a network the government itself defined. That\u2019s the workaround.\u201d<\/p>\n
