Elections don\u2019t vex a man who uses force to erase them<\/u>, which suggests most analysts got his slush-fund reversal wrong<\/u>. As I see it, Trump didn\u2019t drop the looting to soften the results in November. He dropped it to avoid having to name his third AG.<\/p>\n

Trump and Todd Blanche quickly repackaged Trump\u2019s IRS case without the \u2018anti-weaponization fund\u2019 because of an extremely unusual . Even Trump understands how a finding of \u2018fraud upon the courts\u2019 paired with larceny would tar his legacy, especially if his own AG is permanently disbarred<\/u> over it. <\/p>\n

Thirty-five federal judges express shock <\/strong><\/p>\n

On May 27, 2026, thirty five retired federal judges of all political stripes<\/u> filed a motion to reopen against the court. The significance of what they wrote cannot be overstated. <\/p>\n

The motion suggested that the DOJ had \u201cdeceived\u201d U.S. District Judge Kathleen Williams <\/u>by announcing a settlement to the public after failing to mention it to the court. It was an \u201c, the judges wrote, where (Blanche) \u201cdismissed this case before the Court could complete its inquiry into whether there was an actual case or controversy, and then cited the \u2018settlement\u2019 of this case as the legal justification for looting the federal treasury of $1.776 billion dollars and purporting to release all possible federal claims against President Trump, his family, and his businesses.\u201d<\/p>\n

The judges aren\u2019t just frothing over the larceny. The fraud, they noted, is bigger and more consequential. Trump\/Blanche tried to manipulate and defraud, then circumvent and forever silence a federal court. Blanche tried to orchestrate that court\u2019s imprimatur on an unprecedented theft of taxpayer funds, knowing full well that the court had no jurisdiction and never could because there was no case or controversy<\/u>. If Trump sits on both sides of the same case, both controlling the outcome and financially benefitting from it, there is no legal controversy. There is no case. There is only theft, and claiming otherwise is fraud.<\/p>\n

\u201cMost egregious conduct\u201d<\/strong><\/p>\n

The judges didn\u2019t hold back, suggesting that this case demonstrated \u201c.\u201d The parties \u201cused the proceedings before this Court as a legal pretext,\u201d they wrote, \u201cwhile trying to deprive this Court of the opportunity to determine whether this was a real case or controversy in the first place. To (allow it) would be, in effect, to reward and immunize such collusion from judicial scrutiny, since the parties to such a scheme will obviously never challenge\u201d fraud that benefits them personally.<\/p>\n

They argue that Blanche corruptly sought judicial cover for collusion. \u201cIndeed, the corruption of the judicial process is exactly what happened here. The parties have used this lawsuit\u2014which was never an adversarial proceeding over which the Court even had jurisdiction\u2014as a means to allow a \u201ccommission\u201d controlled by the President to dole out $1.776 billion in taxpayer dollars without constitutional or congressional authority to do so, and to confer unlawful private benefits to the President and his family by purportedly prohibiting the United States from prosecuting any and all claims against them.\u201d<\/p>\n

Blanche \u201cplainly tried to shield (his) conduct from necessary judicial scrutiny by short-circuiting this Court\u2019s inquiry into whether the lawsuit is in fact an actual case or controversy by filing (the dismissal<\/u>) before they announced the \u201csettlement\u201d \u2014clearly in hopes of preventing the Court from ever completing that inquiry, which, if it comes out against the parties, will undo their collusive \u201csettlement.\u201d<\/p>\n

How Blanche and Trump tried to do it<\/strong><\/p>\n

As I wrote on May 21 in \u2018Todd Blanche should be disbarred for this<\/u>,\u2019 Blanche moved to dismiss the case two days before his brief outlining the court\u2019s jurisdiction was due. Blanche\u2019s orchestrated \u2018settlement\u2019 purported to \u201cbind the United States to a stunningly broad release of potential claims\u201d against Trump for tax evasion, and to pay billions of dollars, against Trump\u2019s underlying claims.<\/p>\n

Blanche failed to assert the most basic defenses to Trump\u2019s IRS claims, defenses Blanche was legally obligated to assert, and which the DOJ has previously asserted in prior claims<\/u>. There was even a prior IRS case involving the <\/u>same<\/em><\/u><\/em> IRS contractor<\/u> as the one who released Trump\u2019s tax returns, Charles Littlejohn. The government sought dismissal of that exact same case on grounds that a contractor was \u201cnot an officer or employee of the IRS,\u201d yet for Trump it was worth $1.8 billion dollars.<\/p>\n

Blanche\u2019s failure to mount any defense at all to Trump\u2019s claims, the judges note, \u201conly emphasizes the fraudulent nature of the \u2018settlement\u2019 reached here\u201d and \u201cstrengthens the conclusion that the litigation was collusive from the start.\u201d Blanche seemingly \u201cperpetrated a fraud on the judicial machinery itself, by fostering an appearance that the litigation involved adverse parties, when, in fact, it did not.\u201d<\/p>\n

Judge Williams ordered the DOJ to respond to the judges\u2019 accusations of fraud upon the court<\/u> by June 14. Blanche will edit that brief knowing that in New York, where he is licensed<\/u>, committing a fraud upon the court is considered egregious conduct that supports immediate suspension or permanent disbarment<\/u>. Removing larceny from the mix won\u2019t save him. <\/p>\n
